Prayagraj A person from Uttar Pradesh had to spend 8 months in jail even after being granted bail by the court. The reason behind this is a small mistake in the order given by the court. Actually, his middle name ‘Kumar’ was not mentioned in the bail order. The applicant’s name in the remand sheet was Vinod Kumar Baruar, while the court order stated his name as Vinod Baruar.
The jail superintendent only held a person in illegal imprisonment for 8 months because of this mistake. Vinod had filed for bail in the High Court and on April 9, the court had also directed his release on bail. But he was not released because prison officials refused to follow the order due to a discrepancy in name. The court came to know about his imprisonment when he applied for a name correction.
Hearing the application, the court directed him to release the applicant, taking seriously the matter of unnecessarily staying in jail for so many months due to a small technical mistake. Also summoned Superintendent of Siddharthnagar District Jail Rakesh Singh. Also, after complying with the court order, the jail superintendent should come to the court and explain why proper departmental inquiry should not be recommended against him.
Later the jail superintendent appeared in the court and also filed an affidavit, which Justice J.J. Munir accepted.
