Lucknow. The Uttar Pradesh State Law Commission has prepared a draft bill related to the proposed population control law. The commission’s chairman Justice Aditya Nath Mittal is likely to submit it to the chief minister on Tuesday or Wednesday. The draft bill recommends barring parents of more than two children from contesting local body elections. Also, emphasis has been laid on promoting one child policy. The UP government can bring a bill related to this in the rainy season session of the legislature.
Suggestions from various sections have been included in this 260-page report prepared by the Law Commission. These are placed in 57 categories. Keeping valid and valid proposals in the report, their legal position has also been clarified. For example, the state government cannot make a law to prevent two more children from contesting elections to become MLA and MP. This right is with the central government.
The bill will be known as the Uttar Pradesh Population (Control, Stabilization and Welfare) Act 2021 and will apply to youths above 21 years of age and girls above 18 years of age. Before finalizing the draft, the commission had invited suggestions and objections on its website. The Commission had received more than 8500 suggestions and objections till the due date 19th July. After considering these suggestions and objections, the Commission has finalized the draft of the Bill.
According to sources, the commission has made partial changes in its recommendations after the objections received regarding the one child policy. A lot of incentives were proposed in the past, which have now been reduced. However, the policy of giving priority to the parents of a child has been retained. The parents of one or two children in government service have been recommended to be given an additional increment for the entire service, as against the earlier recommendation of the commission to give two increments. In view of the practice of polygamy in a particular sect, the commission has recommended deprivation of other facilities including barring all the wives from contesting local body elections if they have more than two children together. The Commission has removed the provisions regarding maternity leave and paternity leave, as the law already exists in this regard.
