Jaipur. The hearing has started in the High Court on the petition of the Sachin Pilot camp once again amid the political rar in the Rajasthan Congress. The 19 MLAs, including Sachin Pilot, were disqualified by issuing a notice issued by Dr. CP Joshi, the Speaker of the Assembly. On the other hand, the Congress Legislature Party (CLP) is scheduled to meet at the Fairmount Hotel in Jaipur. Congress MLAs supporting Chief Minister Ashok Gehlot are staying in this hotel. Senior advocate Mukul Rohatgi is pleading on behalf of the pilot camp.
On Monday, Chief Minister Ashok Gehlot has called a big attack, calling Sachin Pilot as useless, incompetent and fraudulent. He said that the President of the State Congress Committee was working to submerge the party. Pilot stabbed in the back of Congress. He got quite a lot at an early age. Found posts like Pradesh Congress President, MP, Union Minister and Deputy Chief Minister. Responding to Gehlot’s attack, the pilot said that I am saddened by this statement, but not surprised. This is a conspiracy to make my credibility suspicious.
The hearing was held on Monday on the notice issued by Dr. CP Joshi, the Speaker of the Assembly. In the division bench of Chief Justice Inderjit Mahanti and Justice Prakash Gupta, senior counsel Abhishek Manu Singhvi debated on behalf of the speaker, while Chief Whip Mahesh Joshi was also represented. Senior advocate Harish Salve argued on behalf of the pilot.
Senior advocate Harish Salve said that we will not respond to the notice of the speaker, now only the High Court should give its decision. The speaker has intentionally issued notices of misstatement. It is said that before issuing the notice, it was thought that the complaint on which the notice has been issued is not in the jurisdiction. The speaker had already made up his mind. Has any member opposed a legislative act. Said that the issuance of a disqualification notice in the internal affairs of the party is a violation of fundamental rights. Earlier on Friday, he also said that activity outside the assembly cannot be considered a violation of the anti-defection law. The assembly is not in session, so whip has no meaning.
Advocate Abhishek Manu Singhvi, appearing for the speaker, said that the faction has just issued notices to the pilot faction, not disqualified. The court does not have jurisdiction in this matter. The court is yet to hear the disqualification of the legislators. This right rests with the speaker. The court cannot interfere in assembly proceedings. He said that the court cannot interfere until the speaker decides.
