Allahabad High Court has taken a tough stand on the lawyers’ strike in Ghaziabad. The court has said that judicial proceedings cannot be stopped. The court said that advocacy is a noble profession. No lawyer can stop a judicial officer from doing judicial work and any litigant from coming to court to get justice. At the same time, the court expressed hope that the lawyers of Ghaziabad will never stop any litigant from coming to the court. This order was given by Judge Ajit Kumar while disposing of the petition of Ashutosh Kumar Pathak.
The High Court has said that if the lawyers continue the strike, then the judicial officer must do his judicial work. If the litigant wants to argue his case, then the district administration should give him police protection after consulting the District Judge. The court clearly said that if the lawyers are on strike, then no litigant can be left remedy-less. The court has directed the litigant who came to the High Court instead of filing an appeal due to the lawyers’ strike in the tenancy dispute to file an appeal before the tribunal within two weeks and the presiding officer to pass an appropriate order on the stay application of the appeal within a week.

Advocate Atul Kumar Pandey argued on the petition. He said that by the order of November 8, the authority has ordered to vacate the house in favor of the landlord. Ghaziabad lawyers are on strike. Despite having an alternative remedy of filing an appeal, it is not being filed. There is difficulty in getting justice, so the High Court has to be approached.
‘Not getting justice due to strike’
The court said that despite the remedy being available, the litigant is not getting justice due to the lawyers’ strike. In such a situation, the petitioner has been forced to come to the High Court. Therefore, the judicial officer must work even if there is a strike of lawyers. Along with this, the court also said that security should be ensured for the litigant to present his case in the court. The court has disposed of the petition.
