A decision of the SDM court in Rajpur-Khampur village of Baghpat district of Uttar Pradesh has heated up the atmosphere. An order has been issued to demolish a 50-year-old mosque in Baghpat. The SDM court has given the verdict while hearing the complaint of Muslim petitioner Gulsher. Let us tell you that after the order of the High Court, the district administration ordered the demolition of the mosque built by illegally occupying the pond land. Along with this, a fine of Rs 4.12 lakh was also imposed on the Mutawalli.
A mosque has been present in Rajpur-Khampur village for about 50 years. This mosque is known as Takiya Wali Masjid. Muslim youth Gulshar, a resident of the village, filed a case in the court saying that this mosque has been built illegally. Earlier there was a pond here. It is built on the land of the pond. The land should be freed from occupation by demolishing the Takiya Wali Masjid.
Gulshar had filed a petition in the High Court
For this, Gulshar filed a special petition in the High Court on July 29. Hearing Gulshar’s petition, the High Court declared the construction as illegal encroachment and passed an order to dispose it off on the basis of the Revenue Code. When the High Court’s order reached the district administration, the Tehsildar called for a report from the Lekhpal and the lawyers and started an investigation into the entire matter. Then a case was filed in the SDM court and the hearing was started and a notice was issued to the Mutawalli of the mosque on the basis of evidence, facts and documents.
Mutawalli fined Rs 4.12 lakh
Revenue’s District Government Advocate Ravindra Rathi and Additional District Government Advocate Nagesh Kumar presented their side. The hearing went on, allegations and counter-allegations and facts were investigated, then Baghpat Tehsildar Abhishek Kumar declared the mosque built on the pond land as illegal. Along with this, an order was issued to impose a fine of about Rs 4.12 lakh on the Mutawalli and to pay execution expenses of Rs 5 thousand.
Orders have been issued to demolish this illegal mosque built on the pond land in Rajpur-Khampur village and free the land from occupation. To demolish the illegally constructed mosque, a committee of revenue officers will be formed and a time will be fixed, after which the revenue department team along with the police force will be present there and complete the process of demolishing the mosque.
Anger among villagers due to Tehsildar’s order
Now the villagers are angry about this. The villagers are angry about this decision of the local administration. They say that this order is wrong. They have been given 15 days’ time. They will present their side in this matter in the DM’s court and challenge the decision. The mosque will not be allowed to be demolished at any cost. At present, after the Tehsildar’s decision, there has definitely been an increase in the activity in the village, but everyone’s eyes are fixed on whether the bulldozer will run on this Takiya Wali Masjid present in the village or not.
