Lucknow. Allahabad High Court has directed the Central Government to consider the Supreme Court’s direction to implement Uniform Civil Code. It has also been said that the Illegal Conversion Act 2021 does not prohibit the marriage of a couple who believe in the opposite religion. The registrar does not have the right to stop the marriage registration on the ground of not taking permission to change religion from the district authority. The court has directed the police to provide necessary protection and protection to married adult couples of opposite religions and the marriage registration officer to register immediately without waiting for the approval of the district authority.
The Allahabad High Court held that an adult has a constitutional right to choose a life partner of choice. No one has the right to stop the registration of marriage by changing religion. Approval of conversion from the district authority is not binding, but directive. Adult couples of opposite religions do not need the permission of the government, family or society to get married.
The order was given by Justice Sunit Kumar while accepting the petition of 17 couples, including Myra alias Vaishnavi Vilas Shirshikar, Zeenat Aman alias Neha Soti, who were engaged in inter-religious marriage. The bench said that if anyone has cheated or misled, the parties have the right to take civil and criminal proceedings. While ordering the state government to issue a circular to comply with the order, the Registrar General has been directed to send a copy of the court’s order to the Union Law Ministry and the Chief Secretary of the state for compliance.
The bench said that the society is passing through a phase of changes. Strict legal interpretation will nullify the basic spirit of the Constitution. Right to life and right to privacy are guaranteed under Article 21. If two adult couples agree to a marriage despite being of opposite religion, then it will be valid. Everyone has the right to choose his life partner. It is not a matter of beliefs or belief.
Changes in the constitution possible: Allahabad High Court said that the constitution is a living thing. With the change in the society, changes can also be made in the constitution. Constitution is not a stone which cannot be changed. Constitution is philosophy, not grammar. More than 100 changes have been made in it in 70 years.

Salma divorced her husband and married Hindu widower at Arya Samaj Mandir Muzaffarnagar. Pratibha of Shahjahanpur has married a Muslim man.
