Pryagraj. Justice Rahul Chaturvedi of Allahabad High Court has reserved the judgment on the bail application of former minister Azam Khan in the case related to enemy property. On getting bail in this case, the former minister can come out of jail. However, the state government has also filed an application for cancellation of bail in a dozen cases, which are under consideration.
The Azimnagar police of Bareilly had registered a case in 2019 for illegally occupying enemy property and encircling it by making a boundary wall. The land has been included in the university established by the Maulana Jauhar Ali Trust. The police has filed the charge sheet and the court has also taken cognizance of it.
After hearing on December 4, 2021, the High Court had reserved the decision. After this, on 29 April 2022, the state government presented some new facts by filing a supplementary counter-affidavit. A total of 89 cases have been registered against Azam Khan since he became an MP in the year 2019. Except in the enemy property case, all others have got bail.
The government said, the land does not belong to the Waqf Board: On Thursday, on behalf of the state government, Additional Advocate General MC Chaturvedi and AGA Patanjali Mishra had said that Azam Khan has forcibly registered the Waqf property by calling him in his chamber. Masood Khan has written the book. All the provisions of the Waqf Act were kept in abeyance. It is clear from the Khatauni of 1369 that the land does not belong to the Waqf Board. He also presented the document. It was said that after intimidating the officials of the Waqf Board, they have got the Waqf property registered by asking for two registers in the office located at Indira Bhawan. Azam is the life chairman of the trust. For his own benefit, he has registered government land as waqf property. He is the main accused. Senior advocate SFA Naqvi appeared for the Waqf Board.
Claim, get most of the land done: Azam’s lawyer had filed a petition in the Supreme Court saying that the Allahabad High Court has not delivered the decision for a long time after securing the order on the bail plea. The Supreme Court had fixed May 2 for hearing. Azam’s lawyer Imranullah Khan told that the university is built on 350 acres of land. Most of the land has been sold. Some have been leased out by the government. In this, a dispute has been raised stating 13 hectares of enemy property. On 18 July 2006, the District Magistrate had given the land on lease to the University at the rate of Rs 1700 per acre. On 20 October 2014, the custodian canceled the lease. The application for lease is being made continuously by the university.
