The Supreme Court on Tuesday dismissed the petition of Jawan Tej Bahadur, who was dismissed from the Border Security Force (BSF), challenging the election of Prime Minister Narendra Modi from Varanasi constituency in the Lok Sabha elections 2019. Chief Justice SA Bobde and judges AS Bopanna and V. Ramasubramanian said that the appeal has been dismissed. On 18 November, the Chief Justice had said that the Prime Minister’s Office was a ‘unique office’, which had refused to grant adjournment during the hearing of Bahadur’s plea. While Bahadur’s counsel repeatedly sought adjournment.
CJI Bobde said, “We cannot hear this matter indefinitely. It is very important that we are hearing you.”
The Supreme Court reserved its order after hearing the case in detail. In fact, Bahadur moved the Supreme Court to challenge the order of the Allahabad High Court, which rejected his election petition against the Prime Minister.
Significantly, Bahadur’s nomination papers as Samajwadi Party candidate in Varanasi constituency in the 2019 Lok Sabha elections were rejected. Bahadur filed a petition before the Supreme Court, stating that his nomination letter was rejected by the Returning Officer under pressure from BJP. Earlier in 2017, Bahadur was dismissed from service for releasing a video complaining about the perceived poor quality of food served to soldiers.
