new Delhi. Congress leader and MP Shashi Tharoor has got relief from the Delhi High Court in a defamation case filed against a comment made by Prime Minister Narendra Modi. On a petition challenging the summons issued by the lower court, a bench of Justice Suresh Kumar Kait has stayed the criminal proceedings against Tharoor. The bench also sought a reply from the complainant BJP leader Rajiv Babbar on the petition. The petition will be next heard on December 9.
Senior advocate Kapil Sibal and advocate Vikas Pahwa, appearing for Shashi Tharoor, have sought quashing of the lower court’s order of 27 April 2019. Under which he was ordered to appear as an accused in a criminal defamation complaint.
The petition filed through advocate Gaurav Gupta has also sought quashing of the complaint dated November 2, 2018. Pahwa argued that the lower court’s order was not law-abiding and against the principles laid down in criminal jurisprudence. The lower court has completely ignored the fact that Babbar’s complaint is completely false and trivial. A criminal complaint was filed against Tharoor in the lower court by Rajiv Babbar.
Rajiv Babbar had claimed that his religious sentiments have been hurt by the statement of Shashi Tharoor. In October 2018, Tharoor claimed in a statement that an unidentified person from the Swayamsevak Sangh had allegedly compared Prime Minister Modi to a scorpion sitting on Shivling. Tharoor was granted bail by the trial court in the case in June 2019. Rajiv Babbar had said that he is a devotee of Lord Shiva and by making the above statement, Shashi Tharoor has hurt the sentiments of crores of Shiva devotees
