The Allahabad High Court on Wednesday reserved its verdict on the plea of the Muslim side seeking withdrawal of its January 11 order directing the clubbing of all cases related to the Krishna Janmabhoomi-Shahi Idgah dispute in Mathura. When the matter was heard, senior advocate Taslima Aziz Ahmadi, appearing for the Muslim side, said that clubbing the cases together would take away their right to oppose all the cases.
He further said that it is premature and the cases should not be clubbed together before deciding the issues and collecting evidence.
Ahmadi also said that until the issues are decided, it cannot be said that the cases are the same. Opposing the plea, Hindu side lawyer Hari Shankar Jain said that clubbing the cases is the jurisdiction of the court and no party has the right to challenge it.
The sole purpose of the objection is to delay the proceedings
Jain also said that the sole purpose of such objection is to delay the proceedings. He said that this court had directed to decide the issues in its order of August 1, 2024, but till date no issue has been decided and the court is only hearing the applications.
The lawyer of the Hindu side also said that the integration of the cases does not mean that the right to fight all the cases will end. Justice Mayank Kumar Jain is hearing 18 cases which have been integrated.
The petition of the Muslim side was rejected
On August 1, Justice Jain dismissed the petition of the Muslim side challenging the admissibility of the cases of Hindu worshippers and said that all the cases are admissible.
The court had admitted that these cases are not barred by the Waqf Act, Limitation Act and Places of Worship Act 1991. Prohibits the conversion of any religious structure that existed at the time of independence on August 15, 1947.
These suits have been filed by the Hindu side for possession after demolition of the Shahi Idgah mosque structure. The dispute is linked to the Shahi Idgah mosque in Mathura, built during the time of Mughal emperor Aurangzeb, which is said to have been built by demolishing a temple located at the birthplace of Lord Krishna.
