Prayagraj: Allahabad High Court said that Gangster Act is a special criminal law. It cannot be ended on the basis of agreement. The court said that although a settlement has been reached between the complainant and the accused for offenses under the Indian Penal Code, it will not have any impact on the offense under the Gangster Act.
Along with this, the petition of Congress leader Ajay Rai and four others, demanding cancellation of the ongoing trial case under the Gangster Act registered at Chetganj police station in Varanasi, has been rejected. This order has been given by Justice Sanjay Kumar Singh.
The court said that the Gangster Act case has been instituted by the state government and not on the complaint of the complainant. It is an independent crime, which cannot be extinguished by agreement. There is no legal provision by which case proceedings can be interfered with.
