Lucknow. The Central Bureau of Investigation (CBI) is going to tighten the noose on Ashok Pathak, accused of cheating of about Rs 45 crore by selling land in a forgery case. CBI is gathering more evidence against him. He was arrested on May 7 only.
The special CBI court on Wednesday rejected the bail application of Ashok Pathak, who was arrested in the case of filing a petition under a pseudonym and fraud of crores in the High Court. Ashok Pathak was wanted in two different cases. He was also looking for in the FIR registered in the year 2016. The first case is related to the filing of a petition in the High Court by forging the signature of the Mutawalli of the Waqf Board. Apart from Ashok Pathak, an FIR was registered against others including an advocate in this case.
It was alleged in the petition that the land acquisition order of May 10, 2016 of the state government was invalid as the land belonged to the waqf. After the investigation, a charge sheet was filed against Ashok Pathak and other accused in the special CBI court on 30 December 2020. After this, the concerned land was entered back into the account of the state government.
The second case is also related to the filing of contempt petition under the forged signature of Mutawalli of the Waqf Board. Apart from Ashok Pathak, this FIR was also registered against an advocate and other unknown. This case is related to the filing of contempt petition in the year 2015 by forging signature of Mutawalli of Waqf Board. In this it was claimed that the government had committed contempt by demolishing the construction of the accused persons.
After investigation, in this case also a charge sheet was filed against two accused including Ashok Pathak in the special court on 31 December 2020. Both the petitions were filed before the Lucknow Bench of the Allahabad High Court for grabbing about 57 hectares of government land in Lucknow. This involved an alleged fraud of about Rs 45 crore.
The special CBI court on Wednesday rejected the bail application of Ashok Pathak, who was arrested in the case of filing a petition under a pseudonym and fraud of crores in the High Court. Special Judicial Magistrate Samridhi Mishra has prima facie termed the offense of the accused as serious.
On Saturday itself, the CBI arrested him and sent him to judicial custody. The court had declared him a fugitive offender, and also ordered to issue a permanent arrest warrant against him. Earlier, an order was also given to attach its property.
According to CBI, accused Ashok Pathak had filed a petition in the High Court in the capacity of Director of M/s Land Mark Pvt Ltd through a lawyer under the forged signature of Khurshid Agha. When Khurshid Agha came to know about this, he told that he has not filed this petition.
The High Court then handed over the investigation of the case to the CBI. It also came to the fore in the investigation that the accused along with Kapil Pratap Rana, the alleged secretary of M/s Adhunik Sahakari Home Nirman Samiti, had siphoned off about three crores in the purchase and sale of a land.
