Lucknow. A hearing was held on Thursday in Allahabad High Court regarding the ordinance related to Love Jihad in Uttar Pradesh. The validity of a law meant to prohibit conversion through identity jihad, love jihad, has been challenged in a large court.
In the court, the state government demanded dismissal of all the petitions citing the hearing in the Supreme Court. Now the hearing on these petitions will be held on 15 January.
This order has been given by the bench of Chief Justice Govind Mathur and Justice SS Shamsheri. A counter affidavit was filed on behalf of the state government and the Supreme Court was informed of the action on the petition filed in the same case. It was told that even the Supreme Court has not issued an interim order on the implementation of the law.
The anti-conversion law has been challenged in the petitions, against the constitution and as unnecessary. The petitioner says that this law is contrary to the basic rights of the individual to live and adopt the person on his personal choice and condition. It violates the right to personal freedom. It should be canceled. This law can be misused.
On behalf of the state government, it was said that the law has been brought in order to prevent the conversion of marriage to law and order, which is completely constitutional. This does not violate anyone’s basic rights, but civil rights have been protected. With this, arrangements have been made to ban conversion through deception.
It may be noted that a petition has been filed regarding the ordinance related to Love Jihad by the UP government. The petitioner has termed this ordinance as non-essential and non-constitutional. Earlier in the Supreme Court, there was a hearing on this ordinance related to Love Jihad.
The Supreme Court has given notice to the UP government in this matter. The Supreme Court will examine the constitutionality of these ordinances. However, the Supreme Court refused to stay it.
