new Delhi . Chief Justice (CJI) S.A. Bobde said that if a person from a committee has expressed his view on a matter, it should not form the basis for his disqualification in the committee. This remark made by the CJI of India is very important at this time, because recently the National President of the Bharatiya Kisan Union (BKU) Bhupinder Singh Mann of the apex court to hear the complaints of the farmers agitating against the agricultural laws. Has withdrawn his name from the four-member committee set up by the side.
The Supreme Court had formed a four-member committee to hear the grievances of the farmers, including the name of farmer leader Mann, to end the disputes between the farmers and the government. Mann, however, announced his withdrawal from the committee set up by the apex court to stand with the farmers while talking about the interests of the farmers.
Justice L. The bench headed by Chief Justice, along with Nageswara Rao and Vineet Saran, said, “Just because a person has expressed views on the matter is not a ground for disqualification to be a member of a committee.”
The apex court bench made the remark while the bench was hearing the case to expedite the criminal trial.
During the hearing, a senior advocate cited his opinion in favor of virtual hearing instead of physical hearing. Counsel clarified that the arguments supporting the continuation of the virtual hearing could exclude him from being an amicus curiae.
On this, the Chief Justice said how it could be disqualified.
Chief Justice Bobde said, “Generally, there is a lack of understanding about the formation of a committee.”
At the same time the CJI clarified that his remarks are not only in the context of the instantaneous case, but a general observation.
The Chief Justice said, “We are referring to a general misunderstanding. The members of the committee are not judges. They can change their views.”
Farmer unions have objected to the composition of the court-appointed committee, saying that its members have previously expressed their opinion in favor of agricultural laws.
Thousands of farmers have been demonstrating continuously against the agricultural laws since 26 November at various borders along Delhi. The farmers are adamant on the complete withdrawal of the three agricultural laws. Farmer unions have also refused to appear before this committee.
The apex court had on 12 January stayed the implementation of the three agricultural laws till further orders and constituted a committee, comprising Bhupinder Singh Mann, Pramod Kumar Joshi, Ashok Gulati and Anil Ghanwant.
