Prayagraj Samajwadi Party MP Mo. The Allahabad High Court has stayed the demolition of a resort built in Rampur in the name of Dr. Tanzin Fatima, wife of Azam Khan. The division bench of Justice Shashikant Gupta and Justice Piyush Aggarwal heard the case on Tuesday in the High Court. The Allahabad High Court has ordered the petitioner to file a departmental appeal against the demolition order within two weeks and dispose of the appeal in four weeks to the authority concerned. No demolition action will be taken during this time.
Tanzin Fatima’s lawyer Safdar Ali Kazmi said that the appeal would be filed within two weeks. Till then the demolition action should be stayed and the appeal disposed of within a certain period.
The Allahabad High Court said that the petitioner has the option of filing an appeal, so he should file an appeal in two weeks along with the copy of our order and the concerned authority should dispose of the appeal in four weeks on merits. During the next six weeks or until the disposal of the appeal, whichever is earlier, the demolition action will not be taken. The court also said that if the petitioners do not file an appeal then they will not get the benefit of this order.
The demolition notice issued by Rampur Development Authority on 27 August 2020 was challenged by Dr. Tanzin Fatima in Allahabad High Court.
