new Delhi. The Supreme Court on Wednesday refused to hear the petition challenging Netflix’s order of a lower court in Bihar. In this order, the lower court of Bihar had barred Netflexi from using businessman Subrata Roy’s name in the upcoming web series ‘Bad Boy Billionaires’. The series was scheduled to release in India on Wednesday. Chief Justice S.A. The bench headed by Bobde refused to consider Netflix’s petition. However this has given the OTT platform the liberty to go to the Patna High Court to challenge the order given by the Araria Trial Court. The top court refused to hear the appeal, saying, “We are sorry.”
Senior advocate Vikas Singh, representing Sahara India, opposed the petition filed by Netflix. Singh argued before the bench that the order was passed by a civil judge and if there was to be an appeal, it would have to be filed before the District Judge and not before the High Court or the apex court.
Senior advocate Mukul Rohatgi, representing Netflix, argued before the bench that the apex court should move all the petitions regarding the web series, which are pending in various high courts. The apex court has issued notice on the petition seeking transfer of the cases pending before various high courts by Netflix.
