new Delhi . The case of disregarding reservation rules in the advertisement for recruitment to various posts in AIIMS Rae Bareli has reached Delhi High Court. A bench of Chief Justice DN Patel and Justice Prateek Jalan issued notice to the Central Government, Ministry of Education and All India Institute of Medical Sciences (AIIMS) seeking its reply. The next hearing on the petition will be held on 24 September. The Constitution Save Trust has filed a petition alleging that the recruitment advertisement issued on various posts of AIIMS Rae Bareli has not followed the guidelines of the Central Government regarding reservation. According to the petition, AIIMS Rae Bareli has advertised recruitment for 158 posts of Professor, Associate Professor and Assistant Professor, but the reservation rules have been ignored in this.
According to the petition, on January 31, 2019, the Department of Personnel, Public Problems and Pensions issued an office memorandum clarifying that 10 percent reservation will be given to the economically weaker section in the direct recruitment of the civil post of the center.
At the same time, the Ministry of Education, in a notification issued on 12 July 2019, while clarifying the rules related to reservation for direct recruitment of central educational institutions, said that 15 percent for SC, 7.5 percent for ST and 27 percent and 10 percent for OBC posts. It is mandatory to be reserved for EWS. The petitioner has sought a direction to amend the recruitment advertisement. At the same time, AIIMS Rae Bareli has claimed that the advertisement has been given only under the guidelines of the Central Government.
