Jaipur . The Rajasthan High Court on Friday directed the Speaker to maintain the status quo in the disqualification notice case sent to the 19 rebel MLAs of the Congress and even accepted the plea of MLA Prithviraj Meena in the court case in which he sent the Center Had sought to form a party. Former Deputy Chief Minister Sachin Pilot and 18 other party MLAs moved the High Court after the Rajasthan Legislative Speaker CP Joshi issued a disqualification notice. The speaker is now withheld for action on the July 14 notice.
The High Court also accepted an application to make the Central Government a party to the case.
In her petition filed on Wednesday, Meena said, “It is humbly prayed that a party / defendant for the present writ petition in the interest of justice and law to the Union of India through the Secretary, Ministry of Law and Justice (Department of Legal Affairs) be made.”
The High Court said that the petition is intact but the matter is sub judice.
Assembly Speaker CP Joshi had in July issued notices to the disqualification of the MLAs of Pilot and rebel MLAs, including Pilot and rebel MLAs, at the Congress Legislature Party meetings on charges of non-involvement and anti-party activities.
The speaker was earlier asked to postpone action in the case for three days last week.
After hearing the arguments of the pilot camp, the High Court on Tuesday granted them relief for three more days and reserved the judgment for 24 July.
Rebel MLAs argued that no whip can be issued when the assembly session is not taking place. He said he had no plans to leave the ruling Congress but wanted a change in the Rajasthan leadership.
Meanwhile, Speaker Joshi filed the CLP in the Supreme Court on Wednesday and is scheduled to be heard on Monday.
