Jaipur. Chief Minister Ashok Gehlot has once again targeted Sachin Pilot amidst the political upheaval in Rajasthan. He said Pilot had been conspiring with the previous BJP to topple the government for the last six months. Nobody believed that the government was trying to topple it. Nobody knew that a person with such an innocent face would do such a thing.
Let us know that the hearing is going on in the Rajasthan High Court on the disqualification notice issued to the rebel MLAs. According to the news agency ANI, the case is being heard by Chief Justice Inderjit Mahanti and Justice Prakash Gupta. Abhishek Manu Singhvi, representing the Speaker of the Rajasthan Legislative Assembly in the case, said that the Speaker’s order can be challenged only on a limited basis, but those grounds are not mentioned in the petition. Significantly, last week, Congress convened a meeting of the legislature party after former Deputy Chief Minister Sachin Pilot adopted rebel attitude. The MLAs of the Pilot faction took action against the whip violations for not attending the meeting. The state assembly speaker had issued a notice to the 19 MLAs, including absentee pilots, about the termination of membership in the meeting. The rebel MLA moved the High Court against this.
Meanwhile, Chief Minister Ashok Gehlot is preparing to call an assembly session in the next few days to knock out Sachin Pilot. In this episode, he has spoken to the Speaker of the Legislative Assembly, Dr. CP Joshi. He will prove his majority by calling the session. On Saturday night, Gehlot handed over the list of 102 MLAs to him after meeting Governor Kalraj Mishra. During this time he also claimed to have a majority. On Sunday, the Governor consulted the experts of the law at his level.

Not constitutional of notice – Salve
The notice of the Speaker in the case was challenged in the High Court by senior advocate Harish Salve and Mukul Rohatgi on behalf of the Pilot camp. Salve said during the last hearing that the whip is valid only during the assembly session. Whip is not valid except for this session. In this case, it is wrong to give notice or demand to cancel the membership. He said that the speaker could not issue notice for the proceedings outside the house. The notice does not have constitutionality. He demanded to set up a bench of two judges. Earlier, the case was heard in the bench of Justice Satish Kumar Sharma. As soon as the hearing began, Harish Salve asked for time to present the amended petition. The court gave him time on this.
