Prayagraj. The Allahabad High Court has given relief to some sub-inspectors posted in Meerut, Shahjahanpur, Bareilly, Firozabad, Gorakhpur, Aligarh and Ballia and has cancelled the order of their removal from the job. The court has directed to reinstate all the sub-inspectors in service with consequential benefits.
This order has been given by Justice Ajit Kumar on the petition of Gaurav Kumar, Rohit Kumar, Sudhir Kumar Gupta, Nirbhay Singh Jadoun and Jyoti and other sub-inspectors. Senior advocates Vijay Gautam and Atipriya, on behalf of the petitioners, said that before removing them from the job, the UP Police Recruitment and Promotion Board neither followed the service rules nor any departmental inquiry was conducted.
According to the facts related to the case, the UP Police Recruitment and Promotion Board published an advertisement on 24 February 2021 for the recruitment of 9027 police sub-inspector posts. In the selection process, it was mandatory to pass the online written examination, scrutiny of records, physical standard and efficiency test and medical examination.
The petitioners were selected in February 2023 after being successful in the entire process. Appointment was given to the post of sub-inspector and sent for training in March 2023. Posting was given in March 2024. The board cancelled their selection on 27 October 2024, saying that they did not take the written examination themselves, but someone else gave it in their place.
No departmental inquiry completed in relation to the allegations
The senior advocate for the petitioners said that the provisions of Rule 14(1) of the Uttar Pradesh Subordinate Police Officers (Punishment and Appeal) Rules-1991 were not followed before passing the order. No departmental inquiry was completed in relation to the allegations.
Even an opportunity to be heard was not provided. The court quashed the order of the recruitment board citing the legal principles propounded by the division bench in Ranvijay Singh vs. Government of India and others and Vijay Pal Singh and others vs. Government of India and others. However, the opposition has been given the liberty to pass fresh orders as per the rules and laws.
