The Allahabad High Court gave a big decision regarding the Sri Krishna Janmabhoomi dispute and the Shahi Idgah dispute in Mathura. The court has directed the Mathura District Judge to decide the civil suit after hearing both the parties afresh. With this, the court rejected the petition of Sunni Central Waqf Board and others, refusing to interfere in the matter of maintainability. The court said that the decision has already come in the matter of maintainability, in such a situation no interference can be made.
Justice Prakash Padia gave this order while hearing the petition of Shahi Masjid Idgah Trust and others. On behalf of Lord Shrikrishna Virajman, a civil suit was filed in the court of the Civil Judge of Mathura, demanding that the decision of 20 July 1973 be canceled and 13.37 acres of Katra Keshav Dev’s land be declared in the name of Shri Krishna Virajman. The plaintiff said that the decision given in 1973 on the basis of the agreement between the two parties regarding the land would not be applicable to the plaintiff as he was not a party to it.
Hearing the objection of the Sunni Central Waqf Board, the court dismissed the civil suit on 30 September 2020, against which an appeal was filed on behalf of Lord Krishna Virajman. The opposition objected to the maintainability of the appeal, the court of District Judge, Mathura accepted the application and converted the appeal into revision application. Five questions were decided on the revision petition. On 19 May 2022, the District Judge’s court quashed the order of the Civil Judge dismissing the suit on 30 September 2020.
What is Shri Krishna Janmabhoomi dispute?
The dispute between Kashi and Mathura is also somewhat similar to that of Ayodhya. Hindus claim that Aurangzeb had demolished the temples in Kashi and Mathura and built mosques there. Aurangzeb had demolished the Vishwanath temple in Kashi in 1669 and in 1670 had issued an order to demolish the temple of Bhagwa Keshavdev in Mathura. After this, the Gyanvapi Mosque in Kashi and the Shahi Idgah Mosque in Mathura were built.
This dispute of Mathura is related to the ownership of a total of 13.37 acres of land. In fact, Sri Krishna Janmasthan has the ownership of 10.9 acres of land while Shahi Idgah Mosque has the ownership of two and a half acres of land. The Hindu side describes the Shahi Idgah mosque as an illegally occupied structure and has also claimed this land. There has been a demand from the Hindu side to remove the Shahi Idgah mosque and to give this land to Shri Krishna’s birthplace.
