The Samajwadi Party has launched a scathing attack on the BJP in the Yogi Adityanath government of Uttar Pradesh after the cabinet minister Rakesh Sachan was sentenced by the court in the government ballast theft case. In Kanpur today, ACMM 3 Court sentenced Rakesh Sachan in a 35 year old case, then his old party i.e. Samajwadi Party got an opportunity to attack minister Rakesh Sachan and BJP.
In the Yogi Adityanath government, Khadi and Village Industries, Sericulture, Handloom, and Textile Industries and Micro, Small and Medium Enterprises (MSME) minister Rakesh Sachan was convicted and sentenced by a Kanpur court in a 35-year-old case. Minister Rakesh Sachan disappeared from the court even before the court’s decision came.
Samajwadi Party’s media cell has made a tweet about this. SP has tweeted that the minister fled from the court after hearing the sentence. Now Yogi ji, tell when will you run the bulldozer at the house/door/establishment of this government gitichor absconding minister. Tell me Yogiji.
It is worth noting that in the Uttar Pradesh government, the cabinet minister of Kanpur Dehat, BJP MLA from Bhoginipur Rakesh Sachan, has been reserved by the ACMM III Court of Kanpur on Saturday, holding him guilty. The ballast theft case against him was pending in the court here. During the debate in the court on Saturday, Minister Rakesh Sachan had reached the court but before the verdict came, he escaped from the court. Rakesh Sachan, a resident of Kidwai Nagar, Kanpur, started his politics with the Samajwadi Party. From SP, he was MLA from Ghatampur assembly seat in 1993 and 2002 and in 2009 he won the election from Fatehpur Lok Sabha seat.
Very close to Mulayam Singh and Shivpal Singh
Rakesh Sachan was considered very close to Mulayam Singh and Shivpal Singh. After this he joined the Congress. Before the 2022 assembly elections, former MP Rakesh Sachan left the Congress and joined the BJP. BJP had fielded Rakesh Sachan as its candidate from Bhognipur assembly seat of Kanpur Dehat and he won by defeating Narendra Pal Singh of SP. He was made MSME minister in the state government. Rakesh Sachan has been identified as a Kurmi leader. The BJP fielded Rakesh Sachan as its candidate from Bhognipur, a Kurmi-dominated area and he also won.
What is the matter
A case was registered against Minister Rakesh Sachan under sections 389 and 411 of the IPC for ballast theft during railway contracting. The stolen ballast was also recovered.
Provision for punishment in section 389: Showing fear of committing an offense (punishment of which is punishable with death or imprisonment for life, or imprisonment for ten years) to any person. Punishment – Ten years imprisonment and fine. It is a bailable, cognizable offense and triable by a Magistrate of the first class.
Punishment provision in section 411
Dishonestly receiving stolen property. The punishment may be imprisonment for a term which may extend to three years, or with fine, or with both. It is a non-bailable, cognizable offense and triable by any Magistrate.
