After the statement of Suspended BJP spokesperson Nupur Sharma, the hearing on the application of Jamiat Ulema-e-Hind filed in the Supreme Court in the matter of operation of bulldozers on the property of the accused of violence erupted in many cities of Uttar Pradesh. Later today the Uttar Pradesh government filed its reply.
The UP government, in response, told the Supreme Court that the recent demolition of properties done in the state was done after due process and it had nothing to do with taking action against persons accused of rioting. The government has taken action against the rioters according to different laws.
Apart from this, the UP government has also told the Supreme Court that the petitioner Jamiat Ulama-e-Hind has selected selected media reports and the allegations leveled by him are false. It has also urged the SC to dismiss the petition.
Let us tell you that in the last two days in the state, bulldozers were also run on the properties of the accused of Hins. A petition was filed directly in the Supreme Court to stop this action of the government. Justice AS Bopanna and Justice Vikram Nath heard the application of Jamiat Ulema-e-Hind.
After the hearing on the bulldozer action, the Supreme Court had asked the Yogi Adityanath government to file a reply in three days. Along with this, the bulldozer had refused to stop the action. The court had also said that all action should be within the legal framework. The court had said that there are also reports that this is an act of retaliation. Now we don’t know how true this is. All these reports can be true or false. If such demolition is done then at least what is being done should be in accordance with the process of law.
On this remark made by the court, Tushar Mehta said on behalf of the Yogi Adityanath government, whether the court can issue instructions to follow the procedure. On this the Supreme Court had said that we are issuing notice. You file your answer within three days. Make sure that nothing untoward happens during this time. Advocate CU Singh on behalf of Jamiat demanded fixing of accountability. He said that the court had demanded a stay on the action immediately. Citing legal provisions, it was said that according to the Regulation of Building Operation Act, no action can be taken without giving the building owner an opportunity to express his opinion.
On this, Justice Bopanna said that notice is necessary, we are aware of it. He had said that according to the UP Urban Planning and Development Act, 1973 also it is necessary to give 15 days notice to the building owner and 30 days to file an appeal. In the rules, it has been said in the rule to give time from 15 days to 40 days, in which at least 15 days have to wait before taking any action.
