Lucknow. The Yogi Adityanath government of Uttar Pradesh has provided the facility of registering the property in the name of loved ones on a stamp of five thousand rupees in the gift deed. Apart from this, a processing fee of one thousand rupees will also have to be paid. On Tuesday, the Yogi Adityanath cabinet approved this important proposal of the Stamp and Registration Department. Initially, the benefit of this scheme will be available for six months.
The family members who come under the purview of donation deed will include father, mother, husband, wife, son, daughter, daughter-in-law, son-in-law, real brother, real sister, son and daughter’s son and daughter. The benefit of exemption will be given by the Stamp and Registration Department from the date of issue of notification. After the exemption, after studying the effect on the revenue and registry, it will also be considered to extend the time limit beyond six months.
This facility is already in place in many states including the major states of Maharashtra, Karnataka and Madhya Pradesh. There, stamp duty exemption is given on the deed of donation of immovable properties between family members. According to the provisions of the Indian Stamp Act, the state government can give this exemption if it wants. On this basis, the Yogi government has decided to provide this facility.
Due to the implementation of this scheme, the state government is expected to suffer an annual loss of about Rs 200 crore. At present, there is a system of charging stamp duty on all types of registries on the basis of circle rate. Due to this, the members of the family get the properties registered only when it is very necessary, so that they do not have to pay stamp duty.
In such a situation, the owner of the family makes a will in favor of the members. After the death of the property owner, many times disputes arise regarding the will. This decision will also reduce these disputes. The State Law Commission had also recommended this to the State Government.
