Prayagraj: Allahabad High Court has said in an important order that making a sexual relationship of marriage should be a crime of misconduct in the law, because today it has become a trend that the culprit makes sexual relations with the intention of cheating.
Marriage in the majority female population of the country is a major promotion and they easily become a victim of these circumstances, which causes their sexual harassment. Such a case is increasing day by day. Because the culprit thinks that he will take advantage of the law and escape from the sentence.
Therefore, it is necessary for the legislature to prepare a clear and special legal framework to deal with such cases, where the criminals make a false promise of marriage. Especially once in cases of making sexual relations or in cases for less time.
The court said that the tendency of making sexual relations should be considered agreed on the basis of wrong facts and it should be considered as a crime of misconduct. In such cases the court can not be a silent viewer and those people can not be licensed, who harasses innocent girls and make sex with them. Court said that ‘women are the object of happiness’ to deal strictly with this mentality of male domination so that women came to a sense of security and can achieve the constitutional goal of removing gender inequality. Therefore, the government prepares a clear and strong legal framework to prevent the growing trend of making a sexual relationship.
Court said that the woman has a very bad effect on the woman’s life and the brain. He has to undergo serious physical and mental pain. Therefore, as long as such a law becomes, considering the need for social reality and human life, the courts should continue to protect those women who have been harassed due to the false promises of marriage or where the circumstances are showing that the accused ever He did not want to fulfill the promise of marriage or he was not able to fulfill this type of promise because he was already married or he had created a relationship with his caste, religion, name.
This order Justice Pradeep Kumar Srivastava has rejected the criminal appeal of Harshavardhan Yadav of Kanpur. Court said that in this case the victim and the accused were already aware of each other. The accused promised marriage and continued to talk about marriage. When the victim was going to Kanpur from the train, the accused expressed his desire to meet him and called him in the hotel by telling the court marij papers.
When the victim reached the hotel, the accused made her sex. This was the first and last sex between them. Immediately after making sex, the accused not only refused to marry but also called the victim to abuse and they are also cast. It has not been said in the bail prayer letter or anywhere that the accused is still willing to marry the victim. This shows that he continued to promise the false promise of marriage from the victim and put emotional pressure on the victim to make sex. After that, as soon as he succeeded in his purpose, he immediately refused to marry the victim.
The court rejected the criminal appeal of the accused. In this case the defense argued that the accused and the victim knew each other for a long time and between them became a relationship with mutual consent. The victim has filed a false complaint with the intention to blackmail the yacha. Court did not consider this argument. In this case, the victim has filed a lawsuit in the Curry and ST / SC Act in the collikarganj police station of Kanpur Nagar against the appellar.
