new Delhi. The CBI on Monday urged the Supreme Court to transfer him to Delhi, where Chhattisgarh Chief Minister Bhupesh Baghel is accused in the alleged sex CD case. A bench of Justice Ashok Bhushan and Justice MR Shah said, list the cases on 11.02.2021 for final disposal. Scholarly lawyers for the parties can in the meantime complete the recommendations.
Solicitor General Tushar Mehta, representing the CBI, submitted before the bench that some witnesses related to the case were being threatened as one of the accused Chief Minister of Chhattisgarh is an influential person.
Mehta said that some of the witnesses are from Delhi and Bombay and urged the apex court to shift the case from Chhattisgarh to Delhi.
Senior advocate ANS representing co-accused Kailash Muraraka Nadkarni said that it would be appropriate if Chhattisgarh is included as a party in the petition, as many allegations have been made against the state government. The bench said that it would investigate this aspect at the next hearing.
The apex court had in October 2019 stayed the criminal trial in the alleged sex CD and sought response from Baghel on the CBI’s plea to shift the case out of state.
The CBI has sought transfer of the case as the accused is now the chief minister and it is feared that he may pressurize the witnesses.
In 2017, the CBI registered a case against Baghel, the then Chhattisgarh Congress president. It was complained that Baghel allegedly tried to frame then state PWD minister and BJP leader Rajesh Moonat in the fake sex CD case.
Munat had filed a complaint against Baghel and senior journalist Vinod Verma for tarnishing his image. The then BJP government of the state transferred the investigation of the case to CBI.
