Lucknow: Mohammad Mohsin Khan, former ACP of Kanpur, has got a big relief from the Lucknow Bench of Allahabad High Court. Mohammad Mohsin Khan is involved in sexual harassment of a Kanpur IIT student. Considering the argument that in the job rules, having a relationship with another woman while having a wife does not prima facie come under the category of misconduct, the court has put an interim stay on the suspension of the IPS officer. On this matter, the court has ordered the state government to file a reply in four weeks. The next hearing will be on July 28.
A single bench of Justice Karunesh Singh Pawar passed this order while hearing the petition of Mohsin Khan. Mohsin Khan has been suspended on the charge of sexually harassing a Kanpur IIT student. Senior advocate LP Mishra, on behalf of the petitioner, argued that the recommendation given by the ADGP for the suspension of Mohsin Khan on March 6, 2025, is wrong under the rules. He has been suspended on the charge of having a sexual relationship with another woman, whereas this type of allegation does not come under the category of misconduct.
Under Rule 29 of the Uttar Pradesh Government Servants Conduct Rules 1956, marrying a second wife while having a wife comes under the category of misconduct, but having sexual relations with another woman cannot be said to be in the category of misconduct. The court, after considering the Uttar Pradesh Government Servants Conduct Rules 1956 and various precedents of the court, issued an interim order and stayed the suspension of Khan.
The IIT student had lodged a report against Mohsin at Kalyanpur police station in Kanpur on December 12, 2024 for sexual harassment on the pretext of marriage. In the complaint given to the police, she had said that Mohsin Khan had taken admission in PhD in IIT. After this, he met the student. He trapped her in his love trap by telling himself to be unmarried. After this, he sexually harassed her for months by giving the pretext of marriage. After investigation, Mohsin Khan was suspended by the government.
