Allahabad High Court has stayed the demolition of more than 100 houses in Dibiyapur, Auraiya. The demolition of the houses was to be done on 14 September. In view of this, the advocates on behalf of the petitioner specially requested the Chief Justice and sought permission to hear the case. On which the Chief Justice constituted a special bench of Justice SD Singh and D Ramesh late in the evening. The bench, while hearing the case late in the evening, has stayed the demolition of the houses.
Senior advocate Amarendra Nath Singh and advocate Ajay Kumar Mishra, representing the petitioner Satya Prakash and others, told the court that on September 9, the District Magistrate Auraiya had pasted notices on the houses of the people and asked them to vacate the possession. After this, a public announcement was also made and preparations were made to demolish the house on September 14.
Requested for immediate hearing
Seeing the administration’s haste to demolish the house, the petitioner placed the matter before the High Court. Requested the Chief Justice for immediate hearing. After this, the special bench sitting for the hearing has stayed the action. Many facts have also been presented before the court on behalf of the petitioner.
The advocate argued that the petitioner has been living on the land of the Irrigation Department in 1968. Rent was also being taken from him till 1993. Meanwhile, on a PIL, the High Court had sought a spot report from the administration. The PIL said that the land of the Irrigation Department has been illegally occupied. After receiving the notice of the High Court, the District Magistrate passed an order for the demolition of the house.
50-60 houses have been demolished
Earlier also, 50-60 houses have been demolished for the widening of Kannauj Marg in Auraiya, while the case of others was pending in the court. The High Court had earlier asked the petitioner to submit a representation before the officials in this matter. Which was rejected by the officials on 4 May 2024 and 20 May 2024.
The DM had put up the notice
After this, the District Magistrate pasted the notice for demolition on all the houses. The next hearing of this case has been ordered to be presented before the regular court on 17 September. After the demolition notice, the people living in the houses were also worried about where they would go with their belongings. At present, the residents have got immediate relief.
