In Badaun district of Uttar Pradesh, SDM Sadar had issued summons in the name of the Governor and ordered him to appear. There was a stir as soon as the copy of this order came out. After this matter, on behalf of Governor Anandi Ben Patel, her secretary had sent a letter to the DM, in which a warning was given. Now the government has suspended the SDM who issued the summons. The DM has suspended Peshkar.
According to the information, the SDM of Sadar Tehsil of Badaun had issued summons to the Governor on October 18, ignoring the legal arrangements from his judicial court. In this the SDM was ordered to appear in the court to present his case. After this, the Secretary to the Governor sent a letter to the District Magistrate.
It was said in this letter that according to Article 361 of the Constitution, no summons or notice can be issued against a person holding a constitutional post. This letter was sent by Badrinath Singh, Special Secretary to the Governor. In this, objection was lodged considering it a violation of Article 361 and instructions were given to the DM to intervene in this matter and present the stand as per the rules and to take necessary action against the person who issued the notice. Now the government has suspended the SDM who issued the notice.
What was the whole matter?
Chandrahas, a resident of village Loda Bahedi of Badaun, had filed a petition in the judicial court after the SDM of Sadar Tehsil, making Lekhraj, concerned PWD officials and the Governor as parties as opposition parties. According to the petition filed in the SDM court, the property of Chandrahas’s aunt Katori Devi had been registered in his name by one of her relatives. After this it was sold in the name of Lekhraj.
The government had acquired the land
A few days later, some part of the said land was acquired by the government near village Bahedi located on Badaun bypass. After the acquisition of that property, Lekhraj received an amount of about Rs 12 lakh as compensation from the government. On knowing about this, Katori Devi’s nephew Chandrahas filed a petition in the Judicial Magistrate Court of Sadar Tehsil.
On this petition, a summons was issued to Lekhraj and the State Governor from the court of SDM Judicial Vineet Kumar on 7 October under Section 144 of the State Code, which reached Raj Bhavan on 10 October. In this summons, the Governor was asked to appear in the SDM Judicial Court on October 18 and present his side.
