After all-round pressure, the government could not muster the courage to bring this bill even in the monsoon session of the assembly, but politics has started on it. There is also dissatisfaction between the ruling party and its allies over some provisions in this bill.
The question arises if the ruling Jharkhand Mukti Morcha and Congress were also not fully convinced with it, then how did it pass from the cabinet? How did the government stand in its favor in the beginning? BJP made it a big issue, then why did the ruling coalition realize that the bureaucracy has done the game? In the Legislative Assembly, the government was defensive and avoided saying that when the bill is not brought then why is it being raised, but even in the Bermo and Dumka assembly by-elections, it will have to answer the question of the attacking BJP that if the government The intention is fine, so how did it pass from the cabinet? There was widespread opposition to the exercise of amending the Chhotanagpur and Santal Pargana tenancy act in the previous Raghuvar Das government. As a result, the governor returned the proposal to the state government.
The Jharkhand Land Mutations Bill 2020, passed by the cabinet by the state government to prevent illegal freeze of lands, may also hang in the balance. The main reason for the protest is the complicated process of action against the officials associated with the process of land allotment. There has been a large-scale illegal settlement of tribals and government land in Jharkhand. Around five thousand cases related to this are going on in different districts across the state. In most cases, the illegal settlement of land has been in collusion with officers.
The new bill has added provisions related to revenue officers with online mutations. It mentions that no court will accept the action of officers related to other works including mutation of land. This means that under normal circumstances no person will be able to challenge in court for any wrongdoing. If there is any irregularity, then action will have to be taken by the state government or the central government. This is the point of controversy.
It is obvious that it would be a complex process for a common man to bring wrongdoing to the fore, hence BJP is presenting it as a bill to protect officers. Now the state government is on the defensive. Secretary, Department of Land Reform and Revenue has clarified that the bill does not advocate for saving officers from anywhere. Chief Minister Hemant Soren is also uncomfortable about the bill. He is saying that no such law will be enacted that would harm the general public, but he is unable to answer the opposition’s question that if his intention was right, then how this bill passed with the cabinet?
Where the ordinance went: The ordinance that was brought in the past to control the corona infection has also been very bad. Now the government is not even discussing this ordinance, which was returned by the governor by objecting to some points. The Jharkhand Infectious Diseases Ordinance 2020 was approved at a cabinet meeting two months ago on 23 July. It provided a fine of Rs 1 lakh and a jail term of up to two years for those who did not follow the rules of lockdown.
This move of Hemant Sarkar was discussed all over the country. Later this ordinance was sent to the Governor for approval. The Governor, while registering an objection to some of the facts mentioned in this Ordinance, had asked the Government to send the Ordinance again, but so far the amendment has not been done. While bringing the ordinance, the government had said that due to no law in this regard, no action is being taken against those who violate the lockdown. This is a good thing. As the transition is increasing across the state, people are not following the guidelines.
