The Allahabad High Court has reserved the decision on the petition filed by the elected SP MLA Pallavi Singh Patel against the notice of the Election Commission by defeating Deputy CM Keshav Prasad Maurya in Sirathu assembly seat of Kaushambi. This order was given by the division bench of Justice Sunita Agrawal and Justice Vikram D Chauhan after hearing the arguments of Pallavi Patel’s advocate Saroj Yadav and Additional Advocate General Neeraj Tripathi on Thursday.
Advocate Saroj Yadav said that during the hearing, the court orally raised the question about the jurisdiction of the notice. SP MLA Pallavi Patel is accused of hiding information about the criminal case registered against him in the nomination papers for the 2022 assembly elections. On the same complaint of Dilip Patel of Sirathu, the Election Commission took cognizance of the matter. After that SDM Sirathu has given notice to Pallavi on 18th and 25th May and 3rd June and sought clarification. This notice has been challenged in the petition.
Accused of hiding information about cases in nomination papers
The complainant accused Pallavi Patel that during the assembly elections she hid the details of the cases registered against her in the nomination papers and got votes in her favor by misleading the voters of the area. It has been said in the complaint that a case has been registered against Pallavi Patel and her husband for grabbing a flat in Lucknow through forged documents at the Gomtinagar police station. Apart from this, the case of grabbing the ancestral house in Kanpur is also going on in the court there. He has hidden this information in his nomination form in the last assembly elections.
It is also alleged that Pallavi tried to usurp family property by luring her mother to make her a Rajya Sabha MP and sent the money received during the election to her in-laws’ house, Jabalpur. Similarly, being the National Vice President of Apna Dal Kamera Party, she contested the elections on the ticket of Samajwadi Party and was elected MLA. Thus at present she is representing two parties, which is contrary to the rules of the Election Commission.
