Lucknow. To deal with the worldwide corona epidemic, the government implemented a nationwide lockdown. During the lockdown, strict restrictions were imposed to strictly follow the protocol. Legal screws were also tightened by registering cases against those who violated these rules. The Yogi Adityanath government of Uttar Pradesh has taken a big decision regarding matters related to Kovid protocol and lockdown violation.
The process of withdrawal of cases registered for violation of Kovid protocol and lockdown will start now. The Yogi Adityanath government of Uttar Pradesh had already announced this, but now a mandate has also been issued by the Justice Department in this regard. It has been clarified in this that the cases registered under the sections of less serious offenses against the public, in which the charge-sheet has been filed in the court, now they will also be withdrawn. There is no talk of withdrawing the cases registered against former and current MPs, MLAs and MLCs in the mandate.
The Uttar Pradesh government had earlier announced that the cases filed against traders for violating the Kovid protocol and lockdown would be withdrawn. Then this decision was made for all the common people. Now taking this process forward, the mandate was issued on Tuesday. It said that there are about three lakh cases registered under the Disaster Management Act-2005, Epidemic Act-1897, Section-188 of IMD and other less serious offenses related to it (punishment of less than two years). Cases in which charge sheets have been filed, except sitting and former MPs, MLAs and MLCs, will be withdrawn.
In this mandate issued by Principal Secretary Pramod Kumar Srivastava, it has been mentioned that a letter was written by the Ministry of Home Affairs, Government of India to the Chief Secretary in this regard. It was said in it that the cases registered in violation of the Kovid-19 protocol should be reviewed, so that ordinary citizens do not face unnecessary court proceedings. In the letter, after review it was suggested to consider withdrawal of cases, accepting which the state government has decided to take this process forward.
The High Court had also passed an order on October 8 to finish these cases in three months. Additional Chief Secretary Home Avnish Kumar Awasthi said that orders have already been given to finish the cases in which charge sheets have not been filed.
Separate procedure for public representatives: In the respective mandate of the Justice Department, there is no talk of withdrawing the cases registered against former and current MPs, MLAs and MLCs. It is clearly written that ‘except these’ the cases of the common man should be withdrawn. In this regard, Law Minister Brijesh Pathak says that under the order of the Supreme Court, there is a different process of returning the cases of public representatives. That process is also going on as per rules.
