Rampur . Uttar Pradesh Police has now filed a supplementary charge sheet in a related case after the Supreme Court directed that senior Samajwadi Party MP Mohammad Azam Khan and his son Abdullah Azam be granted bail in a case of alleged forgery and forgery of documents. Also, both have been booked under non-bailable section of criminal conspiracy. Khan and his son will now have to file a fresh bail plea to get bail in this FIR, filed in Rampur in 2019, related to alleged forgery of birth certificates.
Khan’s wife Tanzin Fatima was also named in the FIR.
Tanzin Fatima was released from jail after the Allahabad High Court had granted conditional bail to the three accused in the case in October last year.
Rampur Additional SP Sansar Singh said, “We have filed a supplementary charge sheet against Azam Khan, his wife and their son in this case and have added section 120B as there is clear evidence of criminal conspiracy.
When asked about the timing of the supplementary chargesheet, Singh said, “We were working on the matter. We took action after receiving an application from the main applicant Akash Saxena (BJP leader) in the matter.”
A senior counsel said that in cases where supplementary chargesheet is filed with fresh charges – even when bail is granted by a court – the applicant has to apply for bail in the new sections added.
This comes as a fresh setback for the father-son duo, who have been in jail since February 2020, and were granted bail by the top court on Tuesday.
The court had said that since the charge sheet has been filed in the case, he should be granted bail after the trial court records the informer’s statement within two weeks.
Azam had allegedly helped his son get a second PAN card by using forged documents. Wrong date of birth enabled him to contest the 2017 assembly elections from Pig constituency of Rampur. Several cases of forgery have been registered against both of them, but in most of them they have got bail.
