Lucknow. The Lucknow bench of the Allahabad High Court has summoned the compliance report of its order dated June 3, 2016, to remove the shrines on public roads etc. from the state government till March 17. The court ordered the public prosecutor to file a compliance report to the chief secretary and other concerned officials within two weeks.
The order was passed by a bench of Justices Devendra Kumar Upadhyay and Justice Manish Kumar on a writ petition filed on behalf of Lavkush. The court observed that on June 3, 2016, on the said petition, the court issued an order asking the Chief Secretary to file a compliance report within seven months, but the report has not been filed. The court, in an order issued on June 3, 2016, said that the Chief Secretary should issue instructions to all the District Magistrates, Senior Superintendents of Police and Superintendents of Police to ensure that there is no religious construction of any kind on any public road. If such construction has taken place on or after 1 January 2011 on a public road, it should be removed and the compliance report sent to the concerned Principal Secretary, who will send a detailed report to the Chief Secretary within two months.
The court said that the religious places should not be built by encroaching on public roads on or after 10 June 2016. The responsibility of this will be that of the concerned District Magistrate, Deputy District Magistrate, and SP-SSP and CO. The court should report the compliance of the said order after seven months on 7 January 2017 by the Chief Secretary.
The court had also ordered the state government to make a plan to ensure that smooth flow of traffic of public roads or streets does not cause any hindrance due to any religious activity and such religious activities Be in the same places as are prescribed for it.
