Prayagraj. The Allahabad High Court has expressed surprise at the decisions of the Civil Judge (Junior Division) and District Judge (Fast Track Court) in Mainpuri, suggesting that both the judges need further training. The court made this remark while hearing the second appeal filed by Shailendra alias Shankar Verma in connection with the disputed property case.
Justice Kshitij Shailendra reviewed the decisions of the Mainpuri Civil Court. He clearly observed a lack of understanding by the Civil Judge (Junior Division) about how to properly understand the counter-arguments filed in the case.
The High Court said, it was surprising that the defense produced two witnesses, whose testimony was not considered at all, which indicates a possible lapse in the trial procedures.
The court found that neither the plaintiff’s claim nor the counter-arguments were properly addressed in the decision of the civil court, making the findings appear meaningless. The court said, according to the decision, the defendant’s suit was dismissed without proper consideration of the arguments presented.
The performance of the District Judge of Room No. 2 of Mainpuri Court was equally surprising, he failed to understand the proceedings properly.
The High Court in its observation said, ‘It seems that both the courts have failed to perform their duties as civil courts. They are merely completing the formalities of writing the judgment without any proper reason.’ The High Court has accepted the second appeal for hearing and issued notice to the opponents.
