Prayagraj. The Allahabad High Court has refused to release on bail the minor married woman of Amar Dubey, the accused in the famous Bikru case. The court observed that not only did other women, including the married woman, played an active role in the heinous criminal incident, but also instigated the male criminals to the point that no policeman could escape alive. Not only this, the petitioner is threatening the residents in the protection home that she can get anyone kidnapped.
The court said that mere being a minor does not entitle anyone to get bail. The crime is not ordinary but the murder of eight policemen. Six policemen were seriously injured in this. The statements of the eye-witnesses made his active role clear. Such an incident is not only going to put the society but the government in panic. If bail is granted, people’s faith in the rule of law will be shaken and the justice system will fail.
This order has been given by Justice JJ Munir while perusing the legal aspects and decisions of both the parties. Advocate Prabhashankar Mishra, appearing for the minor married woman, said that the petitioner was married to Amar Dubey, who was killed in an encounter a few days before the heinous incident of July 3, 2020. She is not a member of any gang and is innocent. He is framed by the police. The minor girl is in danger morally, physically and mentally.
Additional Advocate General Manish Goel said that the accused is 16 years old. He has a sense of guilt. She is intimidating 48 residents in the conservation home by threatening them. The superintendent has also made such a complaint. The injured policemen have said that many women, including a minor married woman, not only took an active role in the encounter, but also incited the men to the point that no policeman could survive. The petitioner supported the husband in the attack. The hidden police officer was firing on him. The court said that the child protection home is meant to reform the child offenders, but releasing him on bail will fail justice. The orders of the Juvenile Justice Board and the subordinate court of Kanpur Dehat not to grant bail to the minor married were accepted by the court and the revision application was rejected.
