New Delhi. The prosecution has demanded the death penalty for Ariz Khan, an alleged Indian Mujahideen terrorist, in the 2008 Batla House encounter. Whereas, Ariz’s lawyer has pleaded to show leniency, citing his young age. Additional Sessions Judge Sandeep Yadav will deliver the sentence at 4 pm.
Significantly, on 8 March, the court convicted Ariz Khan in this case. According to the court, he killed the encounter specialist and inspector Mohan Chand Sharma.
Additional Sessions Judge Sandeep Yadav had said that Ariz Khan, along with his colleagues, shot and killed Special Inspector Mohan Chand Sharma.
Ariz was allegedly on the run after the Batla House encounter. He was arrested almost a decade later in February 2018.
During the court proceedings on Monday, advocate M.S. Khan, in his argument, cited Arise’s young age and demanded that the court show leniency for him.
Senior Public Prosecutor A.T. Ansari demanded the death penalty and said it was a brutal murder of a law enforcement officer and a defender of justice.
Prosecutor Ansari said that the entire society was stunned by the incident.
Ariz has been convicted under sections 186 (obstructing the work of officers), 333 (serious conspiracy to torture someone), 353 (criminal assault on public servant), 302 (murder).
He has also been convicted under sections 277, 174A, 34 of the Indian Penal Code and Section 27 of the Arms Act.
On September 19, 2008, two suspected terrorists of Indian Mujahideen and Inspector Sharma were killed in an encounter with the Special Cell of Delhi Police at Batla House in Jamia Nagar.
Ariz is allegedly associated with the terrorist organization Indian Mujahideen. Police claimed that he was present at Batla House along with four others, and managed to dodge the police during the encounter.
Mohammad Sajid and Atif Amin were among the five people living in the apartment of Batla House during the encounter, while Junaid and Shehzad Ahmed fled and were caught years later. Mohammad Saif surrendered to the police.
In July 2013, a trial court sentenced Indian Mujahideen terrorist Shehzad Ahmed to life imprisonment in the case.
