Earlier, a reward of 50 thousand was declared on Shaista Parveen, wife of Mafia Atiq Ahmed. Along with this, the police has also placed a reward of Rs 5 lakh on Guddu Muslim. Along with this, action has been taken against Sabir under section 82 of CrPC. In this, the absconding accused is declared a ‘fugitive’. Then the property is attached under section 82.
When is the accused declared absconder?
If a court has issued a non-bailable warrant against an accused and despite several notices or summons, the accused does not surrender, then he is declared a ‘fugitive’.
Court issues notice to declare an accused as absconder. However, in legal parlance, it is not called a fugitive, but a ‘proclamation for an absconding person’.
If a person is declared a fugitive, then the police puts a notice on his house. If the court orders, then it is published in the local newspaper as well.
– The provision for issuing proclamation of an absconding person has been made in the Code of Criminal Procedure i.e. Section 82 of CrPC.
