The Supreme Court on Wednesday refused to transfer criminal cases pending against Samajwadi Party (SP) leader Azam Khan in a special court in Rampur outside Uttar Pradesh on the ground of alleged harassment. Chief Justice D.Y. Chandrachud, Justice S. A. Nazeer and Justice P.S. Narasimha’s bench said that more cogent reasons are needed to transfer the pending criminal cases against Khan.
The Supreme Court, however, allowed Khan to approach the Allahabad High Court with a plea to transfer the trial in the criminal cases out of Rampur district in the state. “We would have needed more cogent reasons to transfer a case,” the bench said. Huh. Excuse me We allow you to go to the Allahabad High Court.
‘Justice will not be found in the state’
Senior advocate Kapil Sibal, appearing for Khan, quoted him as saying, “I will not get justice in the state.” I am being harassed…It is not about the judge…It is about the state. The situation will remain the same anywhere in the state. The senior advocate claimed that a fair trial would not be possible in the state and to buttress his allegation of partiality, he cited Khan’s conviction in a case when he had acted as an interim judge of a trial court. The order was challenged and his appeal was pending in the High Court.
Abdullah Azam Khan was convicted by the court
The case related to the alleged forgery of the birth certificate of Khan’s son and the petition was pending in the high court when he was convicted by the trial court. The apex court had on November 7 last year dismissed a petition challenging that order of the Allahabad High Court. In which the election of Mohammad Abdullah Azam Khan, son of SP leader Azam Khan, was ordered to be canceled for the Uttar Pradesh Legislative Assembly in 2017.
Was also guilty in the case of objectionable speech
This case is related to two birth certificates of Abdullah Azam. Khan had allegedly given a wrong date of birth while filing nomination papers for the 2017 assembly elections. The Allahabad High Court in its judgment had disqualified Abdullah Azam from contesting the elections as he was below 25 years of age. He filed his nomination papers as the SP candidate from Swar constituency in 2017. Khan was recently convicted in a criminal case related to hate speech and disqualified as an MLA in the state assembly. Was.
