Lucknow. The Lucknow Bench of the Allahabad High Court has rejected the bail application of Bahubali Mukhtar Ansari in the Barabanki ambulance case. The court in its order said that Mukhtar has a history of 56 cases related to heinous crimes and his fear is such that if he is released on bail, he will influence the witnesses and also tamper with the evidence.
The order was given by a single bench of Justice Dinesh Kumar Singh on Mukhtar’s bail application. The Kotwali police of Barabanki has made Mukhtar an accused in this case. According to the prosecution, he is accused of intimidating Dr Alka Rai and getting an ambulance on the basis of forged papers and used it for commuting from Mohali jail to court in Punjab. It was said that in this ambulance, Mukhtar’s men were stationed for his safety with their weapons off.
Additional Chief Secretary Health Amit Mohan Prasad summoned in contempt: The Lucknow Bench of Allahabad High Court has summoned Additional Chief Secretary Medical and Health Amit Mohan Prasad on August 18 in a case of contempt of court. The court has asked him whether he should be punished for contempt of court order.
This order was passed by a single bench of Justice Jaspreet Singh on the contempt petition filed by Dr. Anil Kumar Shukla. Pranshu Agrawal, the counsel for the petitioner, said that on December 18, 2020 itself, on a petition related to the service of the petitioner, the writ court had given an interim order saying that the subsistence allowance due for the suspension period of the petitioner, if any, should be calculated and given to him.
The writ court had also said that if there is any legal impediment in doing so, then its information should be given to the court and the petitioner. It was stated that the said order was not being complied with and when the petitioner filed a contempt petition in the court, after that an order was passed on 10 August 2021, dismissing the claim of the petitioner for payment of dues.
After hearing the case, the court found that the information of the order dated 10 August 2021 was also given to the petitioner after 11 months on 18 July 2022 when the court on 6 July 2022 called for a clear answer. At the same time, information about the said order dated August 10, 2021 has not been given to the writ court by filing counter-affidavit till date.
On this, the court said that prima facie a case of non-compliance of the order of December 18, 2020 of the writ court is made out. Along with this, the court has also rejected the compliance affidavit of Amit Mohan Prasad.
