Varanasi. The hearing on Saturday was deferred on a monitoring petition filed by Uttar Pradesh Sunni Central Waqf Board and Anjuman Intejamia Masajid in the court of District Judge Om Prakash Tripathi in the Gyanvapi case due to the advocates being on strike. Anjuman Intejamiya Masajid and Sunni Central Waqf Board have filed a monitoring petition in the District Judge’s court against the decision of the Civil Judge (Senior Division Fasttrack). The district judge has fixed the date of March 8 for hearing the monitoring petition.
In the year 1991, the ancient idol Swayambhu Jyotirlinga, Lord Vishvesvarnath and other parties filed a lawsuit in Gyanvapi for the construction of a new temple and granting the right of Hindus to worship. In this case Vadmitra former District Government Advocate Vijay Shankar Rastogi appealed to the court to conduct survey with radar technique from the Survey of India from physical and archaeological point of view of the Gyanvapi campus and the alleged disputed site. The jurisdiction of the Civil Judge (Senior Division Fasttrack) to hear the case was challenged on behalf of the Sunni Central Waqf Board and Anjuman Intejamia Masajid. It was argued on their behalf that after the formation of the Waqf Tribunal, the court of Civil Judge (Senior Division Fasttrack) has no jurisdiction to hear the said case.
The civil judge dismissed the challenge of the Sunni Central Waqf Board and Anjuman Intejamia Masajid on 25 February 2020, after hearing the arguments of both parties and observing the arguments. The court said in its decision that the Waqf Tribunal has jurisdiction to hear the dispute between the Muslims while the civil court has the jurisdiction to hear the non-Muslim ownership hearing. An observation petition has been filed in the district judge’s court on behalf of the civil judge by Anjuman Intajamia Masajid and the Sunni Central Waqf Board.
